Applicable guarantees

Following receipt of your home, the protection offered is of variable duration. More specifically, the warranty applies for a period of one year for the repair of existing and non-apparent defects or poor workmanship.

As for hidden defects, the guarantee can apply three years after taking possession of the home.

As for design, construction or construction defects as well as ground defects, you are protected for five years following the end of the work.

Interesting fact: the warranty is transferable. Indeed, if you sell your home during the warranty period, the new owner will benefit from it for the remaining period.

1 year | Non-apparent defect

A non-apparent defect is a defect that is not easy to see and cannot be discovered without a specific check carried out by a professional. Non-compliance with regulations or manufacturer directives is often associated with this type of deficiency.

Examples: shingle nails outside the nailing zone, faulty electrical circuit breaker, breakage of a plumbing device, breakage of a wall-mounted heat pump, breakage of an electrical device (switch, thermostat, heater, etc.), height of railing too low, absence of smoke alarm, exterior cladding whose slats, moldings or other accessories are loose and noisy, exterior cladding whose parts/accessories lack caulking, flashing membrane that is too thin, etc.

3 years | Hidden defect

The expression hidden vice has two elements: Vice and hidden.

A defect is a defect which reduces the quality of a building and which is significant enough to prevent the owner from using or enjoying his building fully and normally. This defect must be serious enough that if the buyer had known of its existence at the time of purchase, he would not have purchased it or would have paid a lower price. This defect must be hidden. To be hidden, a defect must not be apparent or perceptible by simple examination. It must be unknown to the buyer at the time of purchase and existing at the time of sale.

Examples: lack of insulation in a wall, leaking roof, non-functional foundation drain, absence of vapor barrier under the slab (when required), missing vapor barrier, missing or poorly installed roof flashing, etc.

Warranty Exclusions

Any apparent damage, such as scratches on walls, scratches on floor surfaces, that was not reported during the pre-receipt inspection at the time of delivery of the home.
Repair of defects in materials and equipment supplied and installed by the customer(s) or their subcontractors.
Repairs made necessary by normal behavior of materials such as cracks and shrinkage
Repairs made necessary by a fault of the beneficiary such as inadequate maintenance, misuse of the building as well as those resulting from deletions, modifications or additions made by the client(s) or their subcontractors.
Damage resulting from normal wear and tear of the building.
Parking spaces and storage rooms (sheds) located outside the Building where the residential units are located and any work located outside the Building such as outdoor swimming pools, earthworks, sidewalks, slabs of concrete etc.
